Report of Independent Committee of Inquiry on Sai Wan Ho Development on Inland Lot No. 8955

The Independent Committee of Inquiry (ICI) on the Sai Wan Ho Development on Inland Lot No. 8955 has submitted its report to the Chief Executive, Mr Donald Tsang today (April 19).

The Chief Executive appointed the ICI on November 16, 2005 to conduct an inquiry into the Sai Wan Ho Development, including the Building Authority's exercise of discretionary powers and, having regard to the findings, how the concerned departments may better perform their functions in the relevant areas. The ICI comprises the Honourable Mr Justice John Barry Mortimer, GBS, non-permanent Judge of the Court of Final Appeal as the Chairman and Dr Cheng Hon-kwan, GBS, JP and Mr Anthony KK Chan, Senior Counsel as members.

Mr Tsang said, "I am grateful to the Chairman and members for their dedication and hard work in the past few months in completing the report. All departments concerned have fully co-operated with the ICI in the process."

As the former Building Authority has been given leave to apply for judicial review of some of the recommendations and findings in the Director of Audit's report, the Department of Justice would, as a matter of priority, examine the findings and recommendations of the ICI and advise the Government on their implications, if any, on the pending judicial review application made by the former Building Authority. After receipt and consideration of the legal advice, the Government will decide on the actions in handling the ICI's report, including its publication.
