Lands Department re-enters lots in Ma Shi Chau (with photos)

The Lands Department (LandsD) today (April 30) re-entered Lot Nos. 79 and 96 in Demarcation District No. 27, Shui Mong Tin, Ma Shi Chau, Tai Po, New Territories. The District Lands Office, Tai Po, has erected a "Government Land" sign on the site.

The former owner of the lots has breached the conditions of the land lease concerned. Although the former owner had applied for lease modification, the application was rejected by LandsD on December 1, 2011. A number of warning letters had been issued to the former owner by the LandsD since the rejection. However, the former owner failed to rectify the said breach. LandsD therefore decided, upon consideration of the legal advice obtained, to re-enter the lots.

Under section 8 of the Government Rights (Re-entry and Vesting Remedies) Ordinance, Cap. 126, the former owner may, within six months from the registration of the memorial of re-entry, petition the Chief Executive to grant him relief against the re-entry, or apply to the Court of First Instance in its equitable jurisdiction for relief against the re-entry.

According to information made available to the District Lands Office, Tai Po, before LandsD's re-entry, no human ashes had been deposited there. Nevertheless, if any person has negotiated or reached any understanding or agreement with the former owner regarding the use of those lots and related matters, they should consider the need to take actions to follow up with the former owner, and seek professional advice for the purposes as necessary.
