Alignment with the new Companies Ordinance (Cap. 622) and the revised Agreement on Government Procurement of the World Trade Organization (WTO GPA), new assessment aspects of contractors' performance and general updates


It is necessary to revise the Contractor Management Handbook (CMH) to align with the provision of the new Companies Ordinance (Cap. 622) which commenced operation on 3 March 2014 as well the updated guidelines on public works tender procedures issued in pursuant to the revised WTO GPA which came into force on 6 April 2014.

In addition, to suitably reflect the performance of contractors on aspects on manpower training and construction productivity to optimize manpower demands, the standard proforma of the Report on Contractor's Performance and the Guidance Notes for Completion of Reports will be revised with the following new assessment aspects and relevant guidelines added:

  1. Item 7.6 "Training of workers to meet manpower demands" under Section 7 "Industry awareness" (the original Items 7.6 to 7.8 will be re-numbered to Items 7.7 to 7.9);
  2. Item 7.10 "Productivity enhancements" under Section 7 "Industry awareness"; and
  3. Item 9.3(d) "productivity enhancements" under Section 9 "Design".

The revised standard proforma of the Report on Contractor's Performance and the Guidance Notes will become effective from 1 June 2014 (i.e. 2014Q3), and reports with end date on 1 June 2014 and thereafter shall be completed with the use of the revised proforma. The current method of rating of contractor's performance under the Contractors' Performance Index System as detailed in Environment, Transport and Works Bureau Technical Circular (Works) No. 3/2007 and Development Bureau Technical Circular (Works) No. 3/2007A will remain unchanged.

General updates incorporated include, inter alia, clarification on the counting of Housing Authority contracts associated with the eligibility to tender against the tender limit of probationary Group C contractors and other clarification on requirements previously promulgated in various parts of the CMH.
